Copyright & Content Ownership

The Opal Black website, workspace, software, source code, design, layout, text, graphics, templates, packs, skills, prompts, methods, documentation and branding are owned by or licensed to VivoVac Pty Ltd and are protected by the Copyright Act 1968 (Cth) and international treaties. Opal Black™, OPAL BLACK™ and James™ are trademarks of VivoVac Pty Ltd. No right or licence is granted except as expressly stated in our Terms of Service.

You may not copy, reproduce, republish, frame, scrape, decompile, reverse engineer, sell, sublicense or create derivative works of any part of the Services without our prior written consent, except as the law allows.

You keep ownership of everything you provide: prompts, files, price lists, business facts, images, recordings and connected-service data (“Inputs”). You confirm you have all rights and permissions needed to provide them.

As between you and us, you own the drafts, documents, artifacts, code, images and other material generated for you (“Outputs”), and we assign to you any rights we hold in them. Copyright protection for AI-assisted material depends on the law where you are; we do not promise any Output is protectable or free of third-party rights. You must review Outputs before relying on or publishing them.

You grant us a non-exclusive, worldwide, royalty-free licence to host, copy, process and display your Inputs and Outputs only to provide, secure, support and maintain the Services for you. This licence ends when your content is deleted, except for backups kept for the period in our Privacy Policy. We do not sell your content and we do not use it to train AI models unless you opt in.

AI systems are probabilistic. Other users may receive Outputs that are the same as or similar to yours. Your rights do not extend to another user’s Outputs, and we are not liable where independently generated material is similar.

• using the Services or Outputs to build, train, benchmark or improve a competing AI model or product;
• automated scraping, harvesting or bulk extraction of the Services, packs, skills or templates;
• removing or altering copyright, trademark or provenance notices, including AI-image labels;
• uploading material that infringes someone else’s copyright, trademark, privacy or confidentiality.

If you send ideas or suggestions, we may use them freely without obligation to you. This does not give us ownership of your business content.

If you believe material on Opal Black infringes your copyright, email copyright@opalblack.ai with: your contact details; a description of the work; where the material appears (link or share address); a statement that you believe in good faith the use is unauthorised; and a statement that your notice is accurate and that you are the owner or authorised to act. We may remove or disable access to the material, notify the user, and suspend repeat infringers. A user may send a counter-notice to the same address.
